1. Agreement to these terms
These Terms of Use are an agreement between you and KenoSimulator.com ("we," "us," or "the site") covering your use of the website at kenosimulator.com, including its simulator, calculators, generators, and content (together, "the Service"). By using the Service you accept these terms. If you do not accept them, do not use the Service.
2. What the Service is, and what it is not
The Service provides simulation, calculation, and educational tools for the game of keno, for practice, education, and entertainment.
The Service is not gambling. No feature of the Service accepts wagers of money or anything of monetary value, awards money or anything of monetary value, or offers any opportunity to win anything of monetary value. Simulated bets, chips, results, and returns are numbers on a screen with no cash value.
The Service does not predict outcomes. Simulated draws are independent random events. Nothing in the Service improves, forecasts, or influences the results of any real keno game, lottery, or casino product, and no part of the Service should be relied on as a system for real-money play.
Practice results are not representative of real gambling. Real games use their own rules, paytables, and return rates, which differ from our demonstration paytable. Success in a simulation implies no success at real-money gambling.
3. Eligibility
The Service simulates a gambling-style game and is intended for adults. You must be at least 18 years old, or the age of majority where you live if higher, to use the Service. The Service is not directed to children under 13, and we do not knowingly collect personal information from them.
4. Acceptable use
Using the Service, you agree not to
- scrape, harvest, or republish the Service's content or data at scale without written permission,
- probe, disrupt, overload, or interfere with the Service or its infrastructure,
- use the Service to develop, market, or sell any product that claims to predict or beat keno or any gambling game,
- misrepresent simulated results as real-money results, or
- violate any applicable law while using the Service.
5. Intellectual property
The Service's design, text, code, and tools are owned by us or our licensors and are protected by copyright and other laws. We grant you a personal, non-exclusive, non-transferable license to use the Service for its intended purpose. Keno itself is a public game; these terms claim no rights over the game concept, its math, or publicly known facts about it.
6. The companion app and third-party services
The Service links to the Keno Royale mobile app on Google Play and the Apple App Store. The app has its own terms presented in the app and through the stores, and the stores are third-party services with their own agreements. We are not responsible for third-party sites or services reachable from the Service.
7. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We work to keep the math exact and the Service available, and we do not warrant that either will be uninterrupted or error-free.
8. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or losses from real-money gambling decisions, arising out of or related to your use of the Service. To the extent any liability is not excludable, our total liability for all claims related to the Service is limited to one hundred US dollars.
9. Indemnification
You agree to defend and hold us harmless from claims and expenses, including reasonable attorneys' fees, arising from your misuse of the Service or your violation of these terms.
10. Changes to the Service and these terms
We may change, suspend, or retire any part of the Service at any time. We may also update these terms; the date above reflects the latest revision, and continued use of the Service after a revision means you accept it. Material changes will be reflected on this page.
11. Governing law
These terms are governed by the laws of the State of Pennsylvania, United States, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Pennsylvania, and you consent to their jurisdiction.
